1. Acceptance of Terms

By accessing or using LustWrite ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to access or use the Service. By using LustWrite, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service contains adult-oriented content that is not suitable for minors. We reserve the right to request age verification at any time and to terminate accounts that violate this requirement.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. LustWrite will not be liable for any loss or damage arising from your failure to comply with this section. You may not share your account with others or create multiple accounts to circumvent usage limits or bans.

4. Content Policy

LustWrite is a platform for AI-generated adult fiction. All content generated on or through the Service must comply with the following rules:

  • All characters depicted in generated stories must be 18 years of age or older. Any attempt to generate content involving minors is strictly prohibited and will result in immediate account termination and may be reported to the appropriate authorities.
  • Content must be fictional. You may not use the Service to generate content depicting real, identifiable persons in sexual scenarios without their explicit, verifiable consent.
  • Content that promotes, glorifies, or incites real-world violence, hate, or discrimination is prohibited.
  • You understand that AI-generated content may not always align with your prompt. You are responsible for reviewing generated content before publishing.

5. Prohibited Content

The following types of content are strictly prohibited on LustWrite:

  • Any sexual content involving minors, including fictional characters described as or implied to be under 18 years of age.
  • Non-consensual sexual content involving real, identifiable persons.
  • Content that promotes or facilitates human trafficking, sexual exploitation, or abuse.
  • Content designed to harass, threaten, or intimidate any individual.
  • Content that violates any applicable local, state, national, or international law.

Violation of this policy may result in immediate account termination, forfeiture of any remaining tokens or subscription benefits, and reporting to law enforcement where required by law.

6. Intellectual Property

Content generated through LustWrite using your prompts is owned by you, subject to these Terms. You grant LustWrite a non-exclusive, worldwide, royalty-free license to display, distribute, and promote any content you choose to publish publicly on the platform. You retain the right to use, modify, and distribute your generated content outside of the platform. The LustWrite name, logo, and all related branding are the property of LustWrite and may not be used without prior written permission.

7. Payment Terms

Paid subscriptions are billed on a recurring monthly basis through our payment processor, CCBill. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel. You may cancel your subscription at any time through your account dashboard. Upon cancellation, your subscription remains active until the end of the current billing period. Refunds are available within 7 days of purchase in accordance with our refund policy. Token balances are non-transferable and non-refundable. Unused tokens do not roll over between billing cycles.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, illegal activity, or abusive behavior. Upon termination, your right to use the Service ceases immediately. We may, but are not obligated to, provide you with an opportunity to export your content prior to termination. Any remaining token balance or subscription time is forfeited upon termination for cause.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. LustWrite does not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated content may contain errors, inconsistencies, or unexpected output. We do not guarantee the quality, accuracy, or suitability of any generated content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, LustWrite and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if LustWrite has been advised of the possibility of such damages. Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to LustWrite in the twelve (12) months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts.
